Syncs.Design株式会社（以下甲という）のSyncs.Earthをご利用いただきありがとうございます。
お客様（以下、お客様という）に甲所有のアイテム（以下商品という）商品及びその商品の全ての付属品部品（以下商品という）をご利用いただきます際は、次の事をお約束していただきます。
【Ⅰ．循環購入】
１．この循環購入は、甲が所有する商品を有償で利用する権利（以下循環購入という）をお客様が申し込むものです。
２．循環購入の目的は、甲とお客様が相互に協力し合い、限りある資源を循環活用すると共に経済的な持続性を維持することを目的とします。
３．循環購入することによりお客様には商品を利用する権利が付与されますが、商品の所有権は甲に帰属します。
４．利用する権利の範囲は、循環購入頂いた商品ならびに数量の範囲となります。
５．弊社規定に則り、決済手続きが完了した後にキャンセル処理させて頂く場合が御座います。この場合は、利用料金は発生致しません。
６．循環購入費用は商品ごとに定められた金額を決済登録頂いたクレジットカードおよび弊社が割り当てたその他支払い方法により申し込み時にお支払い頂きます。
７．循環購入費用は月額料金もしくは日額はございません。月割および計算日割り計算による返金は致しかねますので予めご了承ください。
８．弊社が指定する住所へ商品が返却された時点で解約となり利用権は失効致します。
９．商品ご利用期間中は、商品の所有権は移転されず甲の所有物となります。甲は商品の返還を求めることができます。返還の実施と時期についてはお客様と甲によって決定します。
１０．お客様がこの契約に違反された場合、甲は特段の通知、催告なしでこの契約を解除する事ができるものとします。この場合、お客様は直ちに商品を返還しなければなりません。
１１．商品の返還は宅配便・レターパック等荷物の追跡が可能な配送手段（送料はお客様負担）となります。
１２．サイズ交換については、お客様より事前にメールでご連絡を頂いた上で商品がお手元に届いてから5営業日以内で可能です。交換手数料980円を頂戴し送料は甲の負担となります。また、商品が試着用のみの場合に限ります。
１３．商品は使用目的に合った使用をしていただき、商品を甲に返還される場合に通常の使用によらない消耗や破損および甲の許可のない改造や修繕が認められる場合は、商品原価相当の費用もしくは修理代金に相当する費用を弁償して頂きます。※日常の着用で生じる消耗や軽微な傷・破れならびにシミや汚れなどは対象では御座いません。
１４．商品について第三者が、差押、仮差押又は権利主張をする恐れがある場合直ちに甲宛にその旨を通知していただきます。
１５．お客様は商品を転売、有償譲渡、質入、転貸、占有移転等の処分をしてはいけません。又商品を改造、修繕してはいけません。これらの行為が認められる場合は、商品ごとに定められた料金の他に甲が一定の基準により算出したその商品の価格と同額を弁償していただきます。
１６．商品を無償で譲渡された第三者は商品の利用においてお客様と同様に利用規約15項が適用されます。
１７．商品を受け取り後すぐに梱包等を開封し、お客様自身で商品チェックしてください。チェック後初期不良と思われる場合は商品の到着後7日以内にご連絡頂くものとします。甲により初期不良と認められた場合、甲は同種同等の代替品を提供いたします。代替品がない場合は上記伝票の申込費用の払戻しをもって一切の責任を免れるものとします。初期不良品の返送は着払いにてご返送下さい。
１８．お客様が商品を使用されるにあたって、お客様の使用上の不注意によって生じた損害については、甲は一切の責任を負いません。
１９．甲はお客様に商品をお渡しした後、お客様に生じた使用目的を達しない等の損害については一切責任を負いません。
２０．商品が盗難、火災に遭った場合にはお客様は盗難届、被災証明をとっていただきます。（国外を除く）甲が保険給付を受けた場合には、免責額を除き弁償金はいただきません。
２１．本規約に定めのないトラブルについては、お客様ならびに甲の両者の誠意をもって解決にあたることと致します。
２２．若しお客様との間に、この契約に関して紛争を生じた場合には、第一審の管轄裁判所は甲の本店を管轄する地方裁判所といたします。

Thank you for using Syncs.Design, Inc. (hereinafter referred to as “Party A”)’s Syncs.Earth.
When using items owned by Party A (hereinafter referred to as “Products”) and all accessories of those products (hereinafter referred to as “Products”), you, the customer (hereinafter referred to as “Customer”), agree to the following terms.
【Ⅰ. Circular Purchase】
1. This Circular Purchase refers to the paid right to use products owned by Party A, which the Customer applies for.
2. The purpose of Circular Purchase is for Party A and the Customer to work together to circulate and utilize limited resources while maintaining economic sustainability.
3. By making a Circular Purchase, the Customer is granted the right to use the product, but ownership of the product remains with Party A.
4. The scope of usage rights is limited to the products and quantities purchased under the Circular Purchase.
5. In accordance with Party A’s regulations, we may cancel the transaction after the payment process is completed. In such cases, no Circular Purchase fee will be charged.
6. The Circular Purchase fee will be paid by the Customer via the credit card registered at the time of application or other payment methods assigned by Party A.
7. There are no monthly or daily fees for the Circular Purchase. Refunds calculated on a prorated or daily basis will not be provided.
8. The agreement will be terminated, and the right to use the product will be invalid once the product is returned to the address designated by Party A.
9. During the use period, ownership of the product remains with Party A, and Party A has the right to request the return of the product. The return timing will be decided between the Customer and Party A.
10. If the Customer breaches this agreement, Party A may terminate this agreement without notice or demand, in which case the Customer must immediately return the product.
11. The return of the product must be made using a delivery method that allows tracking (e.g., courier or letter pack) at the Customer’s expense.
12. Size exchanges are possible if the Customer contacts Party A by email in advance and returns the product within 5 business days after delivery. A 980 yen exchange fee will apply, and Party A will cover the shipping costs. This policy applies only to items intended for fitting purposes (excluding overseas cases).
13. Products must be used for their intended purpose. If the product is returned with wear, damage, or modifications or repairs not authorized by Party A, the Customer will be required to compensate for the product’s original cost or repair costs. (Normal wear and tear, minor scratches, tears, stains, or dirt from regular use are not subject to this clause.)
14. If there is a risk of seizure, provisional seizure, or a third party asserting a claim on the product, the Customer shall immediately notify Party A.
15. Customers may not resell, transfer, pawn, sublease, transfer ownership, or otherwise dispose of the product. Also, do not modify or repair the product. If these acts are recognized, in addition to the fees specified for each product, the Customer will be required to pay compensation in an amount equal to the price of the product calculated by Party A based on certain standards.
16. A third party who receives the product for free will be subject to the same terms of this agreement, including Clause 15, as the Customer.
17. Upon receipt of the product, the Customer must immediately open the packaging and check the product. If the product appears to be defective, the Customer shall contact Party A within 7 days of delivery. If Party A acknowledges the defect, Party A will provide a replacement of the same type and quality. If a replacement is not available, Party A will refund the application fee, and all other responsibilities shall be waived. Return shipping for defective items should be sent via collect postage. For international customers, additional consultation with Party A may be required.
18. Party A shall not be held responsible for any damage caused by the Customer’s negligence during the use of the product.
19. Party A shall not be held responsible for any damages arising from the Customer’s failure to achieve the intended purpose of using the product.
20. In the event the product is stolen or damaged by fire, the Customer must provide a theft report or disaster certificate (excluding overseas cases). If Party A receives insurance benefits, no compensation will be required, except for the deductible amount.
21. Any disputes not specifically addressed in these terms shall be resolved in good faith by both the Customer and Party A.
22. In the event of a dispute regarding this agreement, the court having jurisdiction over the first instance shall be the local court having jurisdiction over Party A’s principal office.
